High Court Appeal Decision

The Council challenged the decision of a district judge to allow an amendment to a summons, and other legal rulings whereby a private prosecution for breach of a noise abatement order could proceed to trial. The council appealed by way of case stated and also brought a claim for judicial review of her decision in the Administrative Court. The appeal was dismissed and permission for judicial review was refused. The case will now proceed to trial. Read more >>

Court Case Update

The hearing of the parish council’s appeal took place at the High Court in Manchester on 8th April. The Parish Council seeks to challenge a series of preliminary rulings by a District Judge at an earlier hearing in the Magistrate's Court in December 2024. After hearing lengthy legal argument from both sides of the case, the Deputy High Court Judge reserved judgment. A written judgment is expected in the coming weeks. Read more >>
